About me

My name is Martijn Huybens. For more than two and a half years I worked with Tobias 365 every day, first as a consultant and later also as domain coordinator. I recently went independent: with more time, more focus and no ticket number.

In that time I supported more than 50 social housing associations and commercial property organisations in setting up their systems, specialising in correspondence and digital archiving. I was also involved in over 15 migrations to Tobias 365. So I am familiar with the software, as well as the social housing associations behind it.

My approach is calm, even when things get tense. I translate technology into plain language, with a methodical way of working and, where it fits, a good laugh. That way IT becomes something you can build on again, rather than something you dread.

Bryte Automation handles your personal data with care. This privacy statement explains which data I process, why, how long I keep it and what rights you have.

1. Who is responsible?

Bryte Automation, based in Haarlem, the Netherlands, registered with the Dutch Chamber of Commerce (KvK). Questions about privacy can be sent to martijn [at] bryte-automation.com.

2. Which data do I process?

Situation Data
Contact form Name, organisation, job title, email address, phone number (optional), subject and your question
Appointment via the calendar Name, organisation, email address, phone number (optional), subject, additional details (optional) and the chosen time
Visiting the website IP address and technical data in the server logs, to prevent misuse and fix errors
Assignment and invoicing Contact details, your organisation's invoicing details and agreements about the assignment
Carrying out an assignment Data in Tobias 365 that I am given access to, such as tenant data. I only process this on behalf of your organisation, under a data processing agreement

3. Why do I process this data?

  • To answer your question and schedule a meeting (legal basis: legitimate interest).
  • To prepare and carry out an assignment (legal basis: contract).
  • To invoice and keep my accounts (legal basis: legal obligation).
  • To keep the website secure and working (legal basis: legitimate interest).

I do not use your data for newsletters or advertising, and I never sell it.

4. How long do I keep it?

  • Contact requests that lead nowhere: up to 12 months.
  • Data on assignments and invoices: 7 years, because of the Dutch tax retention obligation.
  • Data from Tobias 365: no longer than needed for the assignment, and as agreed in the data processing agreement.
  • Website server logs: up to 30 days.

5. Who do I share data with?

Only with parties needed to run the website and my services: the website host (Hostinger), my email, calendar and office software (Microsoft 365, including Outlook and Teams) and my accounting software (Moneybird). Agreements on protecting your data are in place with them. Where a party processes data outside the European Economic Area, this is done under agreements approved by the European Commission.

6. Cookies

This website does not place any cookies.

7. Security

I take appropriate technical and organisational measures to protect your data, such as a secure connection (https), strong passwords and two-step verification.

8. Your rights

You can access your data, have it corrected or have it deleted. You can also object to its use, have its use restricted or have your data transferred. Send your request to martijn [at] bryte-automation.com; you will receive a reply within four weeks. If you disagree with how I handle your data, you can lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).

9. Changes

This privacy statement may be updated. The date at the top shows when this last happened.

Terms and conditions

Article 1. Definitions

  • Bryte Automation: the sole proprietorship Bryte Automation, based in Haarlem, the Netherlands, Chamber of Commerce.
  • Client: the organisation that gives Bryte Automation an assignment.
  • Assignment: the agreed work, such as advice, configuration, support and functional management of Tobias 365.

Article 2. Applicability

  1. These terms apply to all quotations, assignments and agreements of Bryte Automation.
  2. The client's own terms only apply if Bryte Automation has agreed to them in writing.
  3. If a provision is invalid, the other provisions remain in force.

Article 3. Quotations and formation of the agreement

  1. A quotation is valid for 30 days and only binds you once you confirm it, unless stated otherwise.
  2. An assignment is formed as soon as the client confirms the quotation in writing or by email, or as soon as Bryte Automation starts the work.

Article 4. Performance

  1. Bryte Automation carries out the assignment to the best of its ability and with professional skill. This is an obligation of effort, not an obligation of result.
  2. Bryte Automation may decide how and when the work is carried out, within the agreements made with the client.
  3. Stated deadlines are indicative, unless a strict deadline has been expressly agreed.

Article 5. Cooperation of the client

  1. The client provides, in good time, the access, accounts, rights and information needed for the assignment.
  2. The client remains responsible for its own systems, back-ups and decisions about the configuration.
  3. Delays caused by missing access or information are at the client's expense.

Article 6. Fees and payment

  1. The fee is set out in the quotation or the confirmation of the assignment.
  2. Unless agreed otherwise, Bryte Automation invoices monthly in arrears based on the hours spent.
  3. Invoices are payable within 30 days of the invoice date.
  4. In the event of late payment, the client owes the statutory commercial interest, and Bryte Automation may suspend the work after a reminder.

Article 7. Liability

  1. The liability of Bryte Automation is limited to the amount invoiced for the assignment over the last three months, and in any case to the amount paid out by the professional liability insurance in that case.
  2. Bryte Automation is not liable for indirect damage, such as consequential loss, loss of profit or loss of data.
  3. Bryte Automation is not liable for errors in third-party software, including Tobias 365 and systems linked to it.
  4. These limitations do not apply in the event of intent or deliberate recklessness.
  5. A claim must be reported in writing within 12 months after the damage became known.

Article 8. Confidentiality

Both parties keep confidential any confidential information they receive from each other, also after the assignment has ended.

Article 9. Personal data

If Bryte Automation gains access to personal data during the assignment, such as tenant data, the parties will enter into a data processing agreement. Bryte Automation processes this data only for the assignment and in accordance with the GDPR.

Article 10. Intellectual property

The client may freely use documentation, templates and advice made specifically for the client once they have been paid for. Bryte Automation retains the right to reuse general knowledge and working methods.

Article 11. Force majeure

In the event of force majeure, such as illness, third-party outages or system failures, the obligations are suspended. If the force majeure lasts longer than 60 days, either party may terminate the assignment in writing.

Article 12. Termination

  1. An assignment for an indefinite period may be terminated in writing by either party with one month's notice.
  2. Work carried out up to the end date will be invoiced.

Article 13. Governing law

All agreements are governed by Dutch law. Disputes will be submitted to the competent court in the district of Noord-Holland. If this English translation and the Dutch text differ, the Dutch text prevails.
